REGULATIONS OF THE ONLINE STORE "STONE SKIRTS"
effective from July 1, 2016

§ I. General provisions

  1. These Regulations are the regulations referred to in Art. 8 of the Act on the provision of electronic services.
  2. These Regulations define the rules for using the online store available at: www.stoneskirts.eu .
  3. Online store, operating at: www.stoneskirts.eu , is run by an entrepreneur entered in the Central Register and Information on Economic Activity of the Republic of Poland and running a business under the name "Stone Skirts Anna Szczygielska" in Białystok (15-869) at ul. Białystok 22A, with NIP number 5423071300 and REGON number 200745573.

  1. Whenever the terms listed below are used in these Regulations, they should be understood as:
  2. Customer - a natural person, a legal person or an organizational unit that is not a legal person, which is granted legal capacity by special provisions and who places an Order in the STONE SKIRTS Online Store;
  3. Wholesale Customer - a Customer who is a natural person, a legal person or an organizational unit that is not a legal person, which is granted legal capacity by special provisions and who places a Wholesale Order in the Online Store STONE SKIRTS directly in connection with your business or professional activity. In order to obtain the status of a wholesale customer, it is necessary to inform STONE SKIRTS electronically at the following address: marketing@stoneskirts.pl about your desire to obtain the status of a wholesale customer. A wholesale customer making further resale, especially to retail consumers, is obliged to properly mark the ordered goods in accordance with applicable regulations and requirements. The price of the goods for further resale by the wholesale customer should not be lower than the price of the goods in the online store www.stoneskirts.eu . In the event of a reduction (promotion/sale) of regular prices of goods in the Online Store www.stoneskirts.eu , the wholesale customer also has the right to change the level of prices of goods using the minimum prices as in the Online Store www.stoneskirts.eu . Some of the provisions of the Regulations apply only to wholesale customers, which is expressly stated, in other cases the provisions of the Regulations relating to customers will apply;
  4. Civil Code - Act of April 23, 1964 (Journal of Laws of 1964, No. 16, item 93, as amended);
  5. Consumer – a Customer who is a natural person who performs a legal transaction with STONE SKIRTS that is not directly related to his business or professional activity, in particular who places an Order in the Online Store. Some of the provisions of the Regulations apply only to Consumers, which is expressly stated;
  6. Regulations - these Regulations for the provision of electronic services within the Online Store STONE SKIRTS ;
  7. Online store (Store) – online service available at www.stoneskirts.eu , through which the Customer may, in particular, place Orders, run by STONE SKIRTS ;
  8. STONE SKIRTS - an entrepreneur entered in the Central Register and Information on Economic Activity of the Republic of Poland and running a business under the name "Stone Skirts Anna Szczygielska" in Białystok (15 - 869) at ul. Białystok 22A/entrance B, with NIP number 5423071300 and REGON number 200745573;
  9. Goods – all products presented in the Online Store;
  10. Sales Agreement - a contract for the sale of Goods within the meaning of the Civil Code, concluded between an entrepreneur entered in the Central Register and Information on Economic Activity of the Republic of Poland and running a business under the name "Stone Skirts Anna Szczygielska" in Białystok (15-869) at ul. Białystok 22A (entrance B), with NIP number 5423071300 and REGON number 200745573, and the Customer, concluded using the Store's website;
  11. Act on the provision of services by electronic means - Act of July 18, 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended);
  12. Consumer Rights Act - Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827);
  13. Order - the Customer's declaration of will, aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of the Goods;
  14. Wholesale order - a declaration of will of the wholesale customer, aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of the Goods. The minimum value of a wholesale order is PLN 2,000.00 net (in words: two thousand zlotys). Goods purchased under a Wholesale Order are not subject to returns or exchanges. Some of the provisions of the Regulations apply only to wholesale Orders, which is expressly stated, in other cases the provisions of the Regulations regarding Orders will apply;
  15. Pre-Order (Pre-sale) – a pre-order (pre-sale) may apply to any Good. Pre-Orders are placed in advance for Goods that are not yet available. The description of such Goods includes information with the exact date of completion and shipment of such an order. Pre-Order orders are processed independently, within the time specified each time in the description of a given Order and are not subject to "cash on delivery" payment.
  16. These Regulations define the rules for using the Online Store, in particular the conditions and rules for placing Orders electronically within the Online Store, the rules for concluding Sales Agreements using the services provided within the Online Store and the rules for complaint proceedings.
  17. All goods in the Online Store's assortment are brand new.
  18. In order to use the Online Store, the Customer should obtain access to a computer station or terminal device with Internet access on his own.
  19. Customers can access these Regulations at any time via the link on the website's home page http://stoneskirts.eu/pl/content/3-regulamin and download it and print it out.
  20. Information about the Goods provided on the Store's website, in particular their descriptions, technical and operational parameters and prices, constitute an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code.

§ II. Rules for using the Online Store

  1. In order to ensure the security of the transmission of messages and data in connection with the services provided on the website, the Online Store takes technical and organizational measures appropriate to the level of risk to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data transmitted on the Internet.
  2. The Buyer consents to the processing of his personal data by the Seller for purposes related to the execution of the order in accordance with the Act of August 29, 1997 on the protection of personal data (Journal of Laws 2002, No. 101, item 926).
  3. The customer is obliged in particular to:
  4. not to provide or transmit content prohibited by law, e.g. content that promotes violence, is defamatory or violates the personal rights and other rights of third parties;
  5. use the Online Store in a way that does not interfere with its operation, in particular through the use of specific software or devices;
  6. not to take actions such as: sending or posting unsolicited commercial information in the Online Store (spam);
  7. use the Online Store in a way that is not inconvenient for other customers and for STONE SKIRTS ;
  8. use all content posted in the Online Store only for your own personal use;
  9. use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general principles of using the Internet.

§ III. Procedure for concluding a Sales Agreement

  1. In order to conclude a Sales Agreement via the Online Store, please visit the website www.stoneskirts.eu , select products by taking further technical steps based on the messages displayed to the Customer and the information available on the website.
  2. The Customer selects the Goods ordered by adding them to the cart.
  3. When placing an Order, until the "Confirm Order" or equivalent button is pressed, the Customer has the opportunity to modify the entered data and the selection of the Goods. For this purpose, please follow the messages displayed to the Customer and the information available on the website.
  4. After the Customer using the Online Store provides all necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will include information regarding:
  5. subject of the order;
  6. the unit and total price of the ordered products or services, including delivery costs and additional costs (if any), together with all applicable taxes and other components;
  7. selected payment method;
  8. selected delivery method.
  9. Minimum Wholesale Order that will be accepted for execution by STONE SKIRTS amounts to PLN 2,000.00 net (in words: two thousand zlotys).
  10. Wholesale orders over PLN 10,000.00 gross (ten thousand zlotys) require a prepayment of 50% of the order value.
  11. In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the "Confirm Order" button or an equivalent button. An order placed via the Online Store entails an obligation to pay.
  12. Sending an Order by the Customer constitutes a declaration of will to conclude STONE SKIRTS Sales contracts, in accordance with the Regulations.
  13. After placing the Order, the Customer receives an e-mail containing final confirmation of all essential elements of the Order, including confirmation of receipt of the Order along with attachments in the "pdf" format in the form of information on the right to withdraw from the contract and a template of the declaration of withdrawal from the contract.
  14. The contract is deemed concluded when the Customer receives the e-mail message referred to above.
  15. The sales contract is concluded in Polish, with content consistent with the Regulations.

§ IV. Delivery

  1. Delivery of Goods is not limited to the territory of the Republic of Poland and takes place to the address indicated by the Customer when placing the Order.
  2. Delivery of the ordered Goods takes place via the courier company DPD and InPost. Detailed delivery costs will be indicated when placing the Order.
  3. Each Stone Skirts model requires individual preparation time, so the completion date is specified for each individual product. We are a 100% Polish manufacturer.
  4. Customers can access these Regulations at any time via the link on the website's home page http://stoneskirts.eu/pl/content/3-regulamin and download it and print it out.
  5. The essential provisions of the Goods Sales Agreement are recorded, secured, made available and confirmed to the Customer by sending the Customer to the provided e-mail address and by attaching a receipt or VAT invoice to the shipment containing the Goods.

§ V. Prices and payment methods

  1. The prices of the Goods are given in Polish zloty and include all components, including VAT.
  2. The customer has the option of paying the price in the following way:
  3. payment via Paypal.com, Przelewy24.pl, PayNow (secure and instant electronic payment systems);
  4. The Customer must pay for the purchased goods/goods no later than 3 days from the date of conclusion of the Sales Agreement.
  5. The wholesale customer must pay for the purchased goods/goods within:
  6. for the first two wholesale orders - in the form of prepayment for the goods;
  7. from 3 to 10 orders – STONE SKIRTS will issue an invoice with a delayed payment deadline (7 days);
  8. from the 11th order - at the request of the wholesale customer STONE SKIRTS will issue an invoice with a delayed payment deadline (14 days) if previous invoices were paid on time;
  9. in the event of non-payment of the invoices referred to in point b and b on time, the prepayment system for the goods will be used again.

The provisions set out in this point do not apply if the Wholesale Order is for an amount exceeding PLN 10,000.00.

§ VI. The right to withdraw from the contract

  1. Pursuant to Art. 27 of the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827), a Customer who is a Consumer who has concluded a distance contract via the Online Store may withdraw from this contract within 14 days without providing any reason.
  2. Information on the right to withdraw from the contract, containing in particular information on the method and deadline for exercising the right to withdraw from the contract and the costs of returning the item in the event of withdrawal from the contract, which are borne by the Consumer, constitutes Annex No. 1 to these Regulations. The consumer also bears the shipping costs when exchanging goods.
  3. The deadline for withdrawal from the contract starts from the day on which the Consumer took possession of the goods or on which a third party other than the carrier indicated by the Consumer came into possession of the goods. In the case of a contract that includes many items that are delivered separately, in batches or in parts, the deadline for withdrawal from the contract starts from the date on which the Consumer took possession of the last item, the last batch or part or on which the person indicated by the Consumer a third party other than the carrier came into possession of the last item, the last lot or part. In the case of a contract that involves the regular delivery of goods for a specified period of time, the period for withdrawal from the contract begins with taking possession of the first thing. For other contracts, the deadline for withdrawal from the contract starts from the date of conclusion of the contract.
  4. Pursuant to Art. 30 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827), the consumer may withdraw from the contract by informing STONE SKIRTS about its decision to withdraw from the contract by way of an unambiguous statement sent to the address of STONE SKIRTS or the e-mail address of the Store specified in point. 3. § I. of these Regulations. A declaration of withdrawal from the contract may be submitted using the form, the template of which is attached as Annex 2 to these Regulations, but it is not obligatory and may be made in any form. STONE SKIRTS will inform the Consumer about receiving a declaration of withdrawal from the contract.
  5. To meet the deadline for withdrawal from the contract, it is sufficient to send information regarding the exercise of the right to withdraw from the contract before the deadline for withdrawal from the contract specified in point. 1. § VI.
  6. In the event of withdrawal from the contract, the contract is considered null and void. If the Customer who is a Consumer has submitted a declaration of withdrawal from the contract before STONE SKIRTS accepted his offer, the offer is no longer binding.
  7. In the event of withdrawal from the contract, the Consumer is obliged to return the goods immediately, but no later than within 14 days from the date on which he informed STONE SKIRTS on withdrawal from the contract. To meet the deadline, it is sufficient if the Consumer sends the goods before the expiry of the 14-day deadline to the address "Stone Skirts Anna Szczygielska", ul. Białystok 22A, 15 – 869 Białystok .
  8. The consumer is obliged to bear the direct shipping costs for returning and exchanging the Goods.
  9. In case of withdrawal from the contract STONE SKIRTS will immediately, no later than 14 days from the date of receipt of the Consumer's declaration of withdrawal from the contract, refund all payments received from the Consumer, including the costs of delivering the Goods. If the consumer has chosen a method of delivering the item other than the cheapest, usual method of delivery offered by STONE SKIRTS , STONE SKIRTS is not obliged to refund the additional costs incurred by the consumer.
  10. Payment will be refunded by STONE SKIRTS using the same method of payment as used by the Consumer, unless the Consumer has expressly agreed to a different method of return, which does not involve any costs for him.
  11. STONE SKIRTS may withhold the refund of payments received from the Consumer until it receives the goods back or until the Consumer provides proof of returning the goods, depending on which event occurs first.
  12. The consumer is liable for any reduction in the value of the item resulting from using it in a manner other than necessary to establish the nature, characteristics and functioning of the item.
  13. Pursuant to Art. 38 of the Act of April 30, 2014 on consumer rights (Journal of Laws of 2014, item 827), the right to withdraw from a distance contract is not available to the Consumer in relation to contracts:
  14. for the provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the provision of services that after the entrepreneur has completed the service, he will lose the right to withdraw from the contract;
  15. in which the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or serving to meet his individual needs;
  16. in which the subject of the service is an item that deteriorates quickly or has a short shelf life;
  17. in which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery;
  18. in which the subject of the service are items which, after delivery, due to their nature, are inseparably connected with other items.
  19. RETURN CONDITIONS FOR THE "-70% ON THE SELECTED SET" PROMOTION
  20. The return of Goods purchased as part of a promotional campaign means the Customer's resignation from participation in this promotional campaign in relation to this Good. In the event of returning Goods purchased as part of a combined promotional campaign, the Seller will recalculate the price of the entire order (i) taking into account the terms of the promotional campaign under which the Goods were purchased, excluding the returned Goods, or (ii) without taking into account the promotional terms if the remaining part of the order does not meet the conditions of the promotional campaign under which the Goods were purchased. In such a case, the Customer will be refunded the difference between the value of the entire order paid by him and the converted value of the order, without taking into account the returned Goods, according to the rules specified above.

§ VII. Complaints about purchased Goods

  1. STONE SKIRTS is obliged to provide the Store's Customers with goods without physical and legal defects. STONE SKIRTS is liable to Customers for defects in the goods under the terms set out in the provisions of the Act of April 23, 1964, Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended), in particular in Art. . 556 et seq. of the Civil Code.
  2. If the sold item has a defect, the Customer may submit a declaration of price reduction or withdrawal from the contract, unless the seller immediately and without excessive inconvenience to the Customer replaces the defective item with a defect-free one or removes the defect.
  3. The customer cannot withdraw from the contract if the defect is immaterial.
  4. Complaints should be submitted in writing using the complaint form, the template of which is attached as Annex 3 to these Regulations. The customer may also submit a complaint in any form, without having to use the above-mentioned. form.
  5. The complaint should include in particular: name and surname, correspondence address, e-mail address to which the response to the complaint is to be sent, if the Customer wishes to receive a response to the complaint via e-mail, date of purchase of the goods. , the type of goods being complained about, a detailed description of the defect and the date of its discovery, the Customer's request, as well as the Customer's preferred method of informing about how the complaint will be considered. When submitting a complaint , STONE SKIRTS must be provided with proof of purchase of the goods. This may be, for example, a copy of a receipt or a copy of an invoice, a payment card printout or other proof of purchase of goods.
  6. The customer who exercises warranty rights is obliged to deliver the defective goods at the expense of STONE SKIRTS to the address "Stone Skirts Anna Szczygielska", ul. Białystok 22A, 15-869 Białystok .
  7. STONE SKIRTS will consider and respond to the complaint immediately, no later than within 14 days from the date of submission of the complaint. The Customer will be informed about the method of considering the complaint in accordance with the data provided in the complaint.

§ VIII. Complaints regarding the provision of electronic services

  1. STONE SKIRTS takes steps to ensure the fully correct operation of the Store, to the extent that results from current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.
  2. The Customer is obliged to immediately notify STONE SKIRTS of any irregularities or interruptions in the operation of the Online Store website.
  3. The Customer may report irregularities related to the operation of the Store by e-mail to marketing@stoneskirts.pl.
  4. The complaint should include the name and surname, correspondence address, type and date of occurrence of the irregularity related to the operation of the Store.
  5. STONE SKIRTS undertakes to consider each complaint referred to in this chapter within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered.

§ IX. Out-of-court methods of dealing with complaints and pursuing claims

  1. In the event of a dispute, the Customer who is a Consumer has the option of using out-of-court methods of dealing with complaints and pursuing claims. In particular, the Customer is entitled to apply to the provincial inspector of the Trade Inspection to initiate mediation proceedings, or is entitled to apply to the permanent consumer arbitration court operating at the provincial inspector of the Trade Inspection to resolve a dispute arising from the concluded sales contract.
  2. A customer who is a consumer may also obtain free help and necessary information from district consumer ombudsmen.
  3. The use of extrajudicial means of dealing with complaints and pursuing claims is voluntary and both parties must consent to the procedure.
  4. The regulations for the organization and operation of permanent consumer arbitration courts are specified in the Regulation of the Minister of Justice of September 25, 2001 on determining the regulations for the organization and operation of permanent consumer arbitration courts (Journal of Laws 2001, No. 113, item 1214).

§ X. Final provisions

  1. In matters not regulated in these Regulations, the provisions of Polish law shall apply, in particular the Act of April 23, 1964, the Civil Code (Journal of Laws of 1964, No. 16, item 93, as amended), and in the case of Customers who are Consumers also include the provisions of the Act of April 30, 2014 on consumer rights (Journal of Laws of 2014, item 827), as well as the provisions of the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2014, item 827). No. 144, item 1204, as amended).
  2. These Regulations contain the following annexes:
  3. Annex No. 1 - Information on the right to withdraw from the contract;
  4. Annex No. 2 - Declaration of withdrawal from the contract;
  5. Annex No. 3 – Filing a complaint.
  6. STONE SKIRTS reserves the right to change these Regulations only for important technical, legal or organizational reasons. The change to the Regulations becomes effective and enters into force on the date indicated by STONE SKIRTS , but not earlier than after 14 calendar days counted from the moment of posting information about the change to the Regulations on the Store's website.
  1. These Regulations enter into force on July 1, 2016 and apply to contracts concluded from that date.
